2. The petitioners apprehend their arrest for the offences alleged under Sections 126(2), 115, 109, 308, 3(5) of the BNS, 2023, registered in connection with Masaurhi P.S.Case No. 597 of 2024.
3. According to allegation, petitioner no.2 assaulted the informant on his head with butt of pistol and petitioner no.1 assaulted him with brick near his eyes, causing injury. Coaccused Ravi Kumar assaulted the informant with an iron rod at his hand.
4. The learned counsel for the petitioners has submitted that both the parties are agnates. There is case and counter case and the injuries are simple in nature. She further submits that petitioner no.1 is suffering from neurological disorder.

5. On the other hand, the learned counsel for the informant opposed the prayer for anticipatory bail by submitting that petitioners badly assaulted the informant. Initially, the informant was rushed to the Sub-divisional Hospital, Masaurhi for treatment and then was referred to the PMCH, Patna. The medical report shows that he sustained comminuted and displaced fracture of frontal bone involving both anterior and posterior walls of frontal sinus.

Considering the above facts and circumstances and the nature of injury which is simple in nature, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate Masaurhi, Patna in connection with Masaurhi P.S.Case No. 597 of 2024, subject to the conditions as laid down under Section 438(2) CrPC/482(2) of the BNSS, 2023.
