The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376,313/34 of the Indian Penal Code.

The informant was in physical relationship with son of this petitioner, who is already in jail. When son of the petitioner refused to marry with her inspite of pregnancy of the informant, the FIR was lodged. Allegation against the petitioner is that he had promised to give Rs. 2,00,000/-. He was also along with the informant and others at the time of termination of the pregnancy.

Learned counsel for the informant opposes the prayer of anticipatory bail of the petitioner.

No.51882 of 2018(2) dt.09-10-2018 2/2 Considering the entire facts of this case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Amdabad P.S. Case No. 75 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
