====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2023 Heard learned Senior counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 406, 419, 420, 467, 468, 471, 120(B) and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 15.10.2022 and has antecedent of two cases.

The allegation in the FIR is that Gautam Mistri along with co-accused persons used to cheat customers through advertisement by alluring them.

Learned Senior counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is

Patna High Court CR. MISC. No.1301 of 2023(2) dt.04-03-2023 2/2 next submitted that similarly situated co-accused Gautam Mistri has been granted bail by order dated 07.02.2023 in Cr. Misc. No. 3200 of 2023 and Babulal has been granted bail by order dated 25.02.2023 in Cr. Misc. No. 10492 of 2023 by learned Coordinate Bench.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sheikhopur Sarai P.S. Case No. 140 of 2021.
