JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2020 The petitioner seeks regular bail in connection with Atri P.S. Case No. 305 of 2017, registered for offences punishable under Sections 399, 402 and 414 of the Indian Penal Code and Section 25(1-b) a/26/35 of the Arms Act. Allegation as per F.I.R. is that police on information of preparation of dacoity by some miscreants, raided the placed and arrested two person, who disclosed the name of petitioner and there is recovery of fire arm from the house of the petitioner.

It has been submitted on behalf of the petitioner that the other accused persons, who were arrested on spot and there is recovery from them and whose confession name of petitioner transpired, has already been enlarged on bail by a coordinate

Having heard both sides, in view of the above submissions, this application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Gaya, in connection with Atri P.S. Case No. 305 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
