JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2020 This is an application for grant of anticipatory bail in connection with Sono P. S. Case No. 128 of 2019 disclosing offences under Sections 147, 148, 149, 341, 323, 307, 302 and 504 of IPC.

As per prosecution case while the daughter-in-law of the informant went to the hand pump for taking water, the same was protested by the petitioner and further allegation is that petitioner and several other accused persons and six other named accused persons assaulted her and when her husband came, he was assaulted on the hand pump, due to which, he died.

Submission of the learned counsel for the petitioner is that she is a lady. No specific allegation has been attributed against her. The impugned order itself shows that one of the

Patna High Court CR. MISC. No.72451 of 2019(2) dt.17-01-2020 2/2 witness has stated that the father of the informant fell down on the hand pump and due to which, he died. Further inquest report also does not support the prosecution case.

Having heard both sides, considering the above submissions and as she is a lady, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-I, Jamui, in connection with Sono P. S. Case No. 128 of 2019.
