The petitioner seeks regular bail in connection with Chanpatiya P.S. Case No. 65 of 2019 for the offence registered under Sections 353, 188 and 387 of the Indian Penal Code. The allegation is regarding the accused persons including the petitioner herein having attempted to encroach the land of the informant whereafter encroachment proceedings were initiated and therein the Anchal Adhikari, Chanpatiya had directed to remove the encroachment, however, the petitioner was threatening to destroy the sugarcane crop being grown by the informant on the land in question.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.69715 of 2019(2) dt.10-01-2020 2/2 that the petitioner is innocent and has been falsely implicated in the present case. The petitioner is stated to be having a clean antecedent and he is languishing in custody since 27.08.2019. Lastly, it is submitted that similarly situated co-accused person has already been granted regular bail by a coordinate Bench of this Court vide order dated 07.08.2019 passed in Criminal Misc. No. 47929 of 2019.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and considering the nature of offence alleged coupled with the fact that the petitioner is having a clean antecedent, I deem it fit and proper to direct for release of the petitioner herein on regular bail.

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bettiah, West Champaran in connection with Chanpatiya P.S. Case No. 65 of 2019.
