JUSTICE SANDEEP KUMAR ORAL ORDER 25-03-2026 Heard the learned counsel for the petitioner, the learned APP for the State, and the learned counsel for the informant.

2. The petitioner seeks regular bail in connection with Mirganj P.S. Case No. 333 of 2025 registered for the offence under Section(s) 80, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the petitioner is the husband of the deceased who is alleged to have killed the deceased for demand of dowry.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Petitioner is in custody since 24.06.2025 and claims clean antecedent.

5. Learned A.P.P. for the State and the learned counsel for the informant have vehemently opposed the prayer for bail.

6. I have considered the submissions of the parties and have gone through the records of the case. From the FIR it appears that the deceased was taken to the hospital and her family members were informed. During the investigation, some witnesses have said that the deceased was ill from before and was being treated at different points of time. The allegation against the petitioner and others is of pressing the neck of the deceased and killing her but the post-mortem report doesn't support the prosecution case. Nothing has come against the petitioner in the FSL Report also.

7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Mirganj P.S. Case No. 333 of 2025.
