JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-04-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). For Issuance of Writ in the nature of Mandamus directing the respondent authorities to

Patna High Court CWJC No.16679 of 2023(2) dt.22-04-2024 2/3 vitiate the entire Selection Process for "Recruitment of Ex- Service men in Permanent Vacancies Of Bank Guard" at State Bank of India, Whereas the entire selection process has been initiated without issuance and publication of any Advertisement by the Respondent Authority and being arbitrary and on pick and choose basis, whereas the selection process has been initiated on the request of respondent no.5 to respondent no.2 for providing detail list of Ex-Army Officer after preliminary screening and on the basis of list respondent no.5 making call to the candidates on pick and choose basis, without following any established procedure of selection and the appointment of candidates were initiated, solely on the discretion of Respondent State Bank of India.

(ii). For Issuance of Writ in the nature of Mandamus directing the respondent authority to initiate a fresh selection after making advertisement and following the due process of selection of Ex-Servicemen in Permanent Vacancies of Bank Guard at different Branches of respondent SBI.

(iii). For Issuance of Writ in the nature of Mandamus directing the respondent authority specially respondent no.5 to consider the candidature of the petitioners after issuing letter and making a call for "Physical Test", Whereas petitioners' name were mentioned in the list

Patna High Court CWJC No.16679 of 2023(2) dt.22-04-2024 3/3 prepared by respondent no.4 i.e "District Soldier Welfare Officer", but in spite of that petitioners have not been called for Physical Test by respondent bank and no reason has been assigned for rejection of their candidature.

(iv). For restraining the respondent authority and granting stay on the entire selection process of Ex- Servicemen in Permanent Vacancies of Bank Guard at Respondent Bank, as the entire selection process has been initiated in suspicious manner on pick and choose basis, without making any advertisement and following selection procedure."

After some arguments, the learned counsel for the petitioners seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioners to approach the Respondent authorities for redressal of their aforesaid grievances. Liberty, so sought, is granted.
