JUSTICE SANJAY PRIYA ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Islampur P.S. Case No. 256 of 2018 instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioner submits that petitioner has not been apprehended on spot. His name has been disclosed by co-accused Wasim Alam and Shashi Ranjan Kumar who were apprehended by the police. No incriminating articles have been recovered from possession of the petitioner. Counsel for the petitioner further submits that petitioner is in custody since 27.07.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the

Patna High Court Cr.Misc. No.56698 of 2018 (2) dt.28-09-2018 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional District and Sessions Judge-cum-Special Judge, Excise, Nalanda at Bihar Sharif, in connection with Islampur P.S. Case No. 256 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
