Mr. Brajendra Nath Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 28-11-2025 Heard Mr. Rabi Bhushan, learned Advocate for the petitioners and Mr. Brajendra Nath Pandey, learned Additional Public Prosecutor for the State.
2. The petitioners apprehend their arrest in connection with Manikpur P.S. Case No. 26 of 2024, registered for the offences punishable under Sections 341, 323, 307, 354, 504/34 of the Indian Penal Code.
3. Allegedly, while the informant was engaged in constructing a boundary wall, in the meanwhile, the informant's sister-in-law (bhabhi) started abusing and when the protest was
Patna High Court CR. MISC. No.77975 of 2025(2) dt.28-11-2025 2/3 made all the petitioners variously armed with lathi, danda and iron rod came to the house and brutally assaulted the informant and others.
4. Learned Advocate for the petitioners, referring to the FIR, contended that both the parties are close relatives and only on account of some disputes regarding partition of a land, they entered into a free fight resulting into some unfortunate injuries, however, the injuries, which are allegedly sustained to the informant's wife, were found to be simple in nature. It is also contended that the petitioners are persons of fair antecedents and they undertake that they will fully cooperate in the proceeding of the court.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application.
6. Having considered the submissions advanced by the learned Advocates for the respective parties and taking note of the genesis of the occurrence as also the fair antecedents of the petitioners, let the petitioners abovenamed be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of
Patna High Court CR. MISC. No.77975 of 2025(2) dt.28-11-2025 3/3 the like amount each to the satisfaction of the learned ACJM-II, Lakhisarai, in connection with Manikpur P.S. Case No. 26 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
