The petitioner apprehends his arrest in Bihar P.S. Case No. 830 of 2020 registered for the offences punishable under Section 419, 420 and 34 of the IPC and Section 10 of the Bihar Examination Act pending in the Court of learned Chief Judicial Magistrate, Nalanda, Bihar Sharif.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. Permission is granted.

Accordingly, the instant application is dismissed as withdrawn. However, if the petitioner surrender before the learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the

Patna High Court CR. MISC. No.3080 of 2023(2) dt.28-03-2023 2/2 order, preferably, on the same day, without being prejudiced by this order, considering the fact that the petitioner has no criminal antecedent.
