JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2023 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Excise Act. The learned counsel for the petitioner submits that the petitioner is in custody since 06.12.2022 and has antecedent of one case and the allegation is of recovery of 189 litres of liquor. The learned counsel for the petitioner submits that petitioner was not apprehended from the spot, as such, nothing was recovered from his conscious possession and he came to be implicated at the instance of local people, but then, the F.I.R. does not disclose, who were the local people, who disclosed the name of the petitioner.

Patna High Court CR. MISC. No.1023 of 2023(2) dt.04-03-2023 2/2 Learned A.P.P. opposes the bail application.

Considering the submission made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Muffasil P. S. Case No.379 of 2022.

The application stands allowed.
