JUSTICE SANJAY PRIYA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Spl (P) 14/18 (POCSO05/18) arising out of Akbarpur P.S. Case No. 51 of 2018 instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 337, 354, 379, 427, 504, 506 of the Indian Penal Code and Section 4 of POCSO Act, 2012.

Counsel for the petitioner submits that there is case and counter case between the parties. The allegation against the petitioner is that he assaulted Nitu Kumari on the head. The injury report of Nitu Kumari has been enclosed as Annexure-2 wherein the Doctor has found lacerated wound over frontal region of head measuring 1/2" x 1/6" x 1/6" caused by hard and blunt substance, which was simple in nature.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Nawada, in connection with Spl (P) 14/18 (POCSO05/18) arising out of Akbarpur P.S. Case No. 51 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
