JUSTICE SANJAY PRIYA ORAL ORDER 29-08-2018 Heard learned counsel for the petitioner and State. This application has been filed for modification of the order dated 10.07.2018 passed by this Court in Cr. Misc. 24974 of 2018.

This Court finds that order dated 10.07.2018 was passed on submission made on behalf of the petitioner that he is ready to make payment of the amount which have been credited in his account as well as the account of his father in nine equal installments subject to final outcome of the case. Therefore, this Court does not find any merit in the application.

Counsel for the petitioner further submits that due to pendency of this modification application, the payment could not

Patna High Court Cr.Misc. No.52996 of 2018 (2) dt.29-08-2018 2/2 be made in the court below in compliance of the order dated 10.07.2018 passed in Cr. Misc. 24974 of 2018. The petitioner is ready to comply with the order dated 10.07.2018 passed by this Court in true spirit. Therefore, four weeks further time may be extended to comply with the aforesaid order.

In such circumstances, this modification application is disposed off to the extent that the time for surrender of the petitioner in the court below is extended for further four weeks from the date of receipt/production of a copy of this order to make payment in compliance of the order dated 10.07.2018 passed in Cr. Misc. 24974 of 2018. If the petitioners surrender in the court below, they will be released on same terms and conditions as mentioned in the order dated 10.07.2018 passed in Cr. Misc. 24974 of 2018.

Let this order be communicated to the Court of Chief Judicial Magistrate, Begusarai, in connection with Begusarai P.S. Case No. 631 of 2017.
