The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 411, 414 of the Indian Penal Code.

As per F.I.R., co-accused person was apprehended on the spot and four stolen motorcycle and one scooty were recovered from bush behind his house and he confessed the name of other co-accused persons including the petitioner.

No.83816 of 2023(2) dt.05-01-2024 2/3 It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Neither the petitioner was apprehended on spot nothing incriminating has been recovered from his conscious possession. The name of petitioner sprang up in this case on the confessional statement of co-accused Md. Fateh. Moreover, the petitioner is languishing in judicial custody since 24.05.2023. Similarly situated co-accused Akmal @ Md. Akmal has been granted bail vide order dated 31.10.2023, passed in Cr. Misc. No. 66985 of 2023 by this Court.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on
