JUSTICE SANJAY PRIYA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Siwaipatti P.S. Case No. 64 of 2018 instituted for the offence under Sections 272, 273, 120(B) of the Indian Penal Code, Sections 30(a), 38, 41 and 48 of Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioner submits that there is no recovery of any foreign liquor from conscious possession of the petitioner. The seizure list does not bear signature of the petitioner.

From the written report it appears that recovery of foreign liquor is made from the Bolero vehicle. The police has mentioned that villagers have disclosed the name of petitioner. Petitioner is said to be in custody since 04.08.2018.

Patna High Court Cr.Misc. No.55495 of 2018 (2) dt.20-09-2018 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur, in connection with Siwaipatti P.S. Case No. 64 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
