KUMAR ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioner, who is in custody, seeks bail in connection with Bhabua P.S. Case No. 346 of 2017 registered for the offence punishable under Sections 302, 307/34 of the Indian Penal Code and Section 27 of Arms Act. Informant has alleged causing firearm injury upon him and his son as a result of which his son died. It has been submitted on behalf of the petitioner is that petitioner is innocent and has been falsely implicated in this case due to village politics. Petitioner has been alleged to be the member of unlawful assembly and also fired from his country made gun. Specific allegation is against Rustam Ansari

Patna High Court Cr.Misc. No.56226 of 2018(2) dt.08-10-2018 2/2 of firing. It has been further submitted that co-accused, namely Hasmuddin Ansari has been granted bail by this Hon'ble Court vide order dated 21.12.2017 passed in Cr. Misc. No. 48366 of 2017 and other co-accused persons, namely Saddam Ansari and Kayum Ansari has also been granted bail by this Hon'ble Court vide order dated 18.04.2018 passed in Cr. Misc. No. 13333 of 2018 and vide order dated 06.10.2018 passed in Cr. Misc. No. 60561 of 2018. Petitioner is in custody since 19.07.2017.

Learned Counsel for the informant has vehemently opposed the prayer for grant of regular bail to the petitioner. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-IV, Kaimur at Bhabua, in connection with Bhabua P.S.
