The petitioner seeks bail in a case instituted for the offences under Sections 379, 414 of the Indian Penal Code and Section37(c) of the Bihar Prohibition and Excise Act. Prosecution case, in short, is that the petitioner was committing theft in drunken state.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 15-07-2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. There is no recovery of liquor from the petitioner. The petitioner has been made accused due to mistake of fact.
Patna High Court Cr.Misc. No.55649 of 2018 (2) dt.07-09-2018 On behalf of the State, it is submitted that the petitioner is named in the F.I.R/complaint case.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Motihari, East Champaran in connection with Paharpur P.S. Case No. 194 of 2018.
