JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2023 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201, 34 of the Indian Penal Code.
The learned counsel for the petitioner submits that the petitioner is in custody since 09.07.2022, he is a person with clean antecedent and the informant alleges that his daughter was married to Kanhaiya Chaupal about 14 years ago and out of the wedlock, three children were born.
It is further alleged that the accused persons including the petitioner used to torture her. It is next alleged that mother of the victim was ill, hence the victim came to meet her, but she was called back to her matrimonial home on 14.04.2022.

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is next submitted that no specific overt act of torture has been alleged against him, nor informant is an eye witness to the occurrence and the petitioner is the brother-in-law of the deceased and the husband of the deceased is in custody. Learned A.P.P. opposes the bail application.
Considering the submission made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ghanshyampur P. S. Case No.89 of 2022.
The application stands allowed.
