JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-12-2019 This is an application for grant of anticipatory bail in connection with Halsi P. S. Case No. 179 of 2019, disclosing offences under Sections 364/34 of IPC.

As per F.I.R. petitioner has taken the husband of the informant on the plea of preparing Aadhar Card and thereafter, he is trace-less.

Submission of the learned counsel for the petitioners is that F.I.R. has been lodged after one month and moreover, earlier husband of the informant has executed a sale deed in favour of the petitioner, due to that informant has send her husband outside and lodged the present case, which will appear from Paras 30 & 31 of the case diary, where the statement of

Patna High Court CR. MISC. No.71487 of 2019(3) dt.02-12-2019 2/2 some of the independent witnesses have been recorded. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, surrender before the court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, they will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of Sri Mahesh Shukla, learned Judicial Magistrate, 1st Class, Lakhisarai, in connection with Halxi P. S. Case No. 179 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that they have to co-operate the police in the recovery of husband of the informant.
