The petitioner is in custody since 14.07.2018 in connection with Sonpur P.S. Case No. 438 of 2015 for the offence registered under Section 395, 397 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has not been named in the FIR, but the name of the petitioner surfaced on the basis of confessional statement by one Lalu Sahni before the police, which has no evidentiary value in the eye of law. The petitioner has no criminal antecedent and is languishing in jail. It is further submitted that no recovery has been made from the conscious possession of the petitioner and he has not been put on TIP.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.57778 of 2018(2) dt.20-09-2018 2/2 the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Saran at Chapra, in connection with Sonpur P.S.
