2. In the present case, the petitioner seeks bail in connection with Banjariya P.S. Case No. 92 of 2025, dated 12.02.2025, registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 118(1), 109, 303(2), 352, 117(2), 351(2) of the B.N.S.

3. As per prosecution case, allegation against the petitioner is that he and other co-accused persons assaulted the informant and his family members causing a number of injuries to them. The petitioner is said to have given a sword blow on the head of the informant causing a deep cut wound.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely

There is inordinate delay of seven days in lodging the F.I.R. and there is no explanation for the same. The parties are agnates having land dispute between them but the informant has sustained only one injury on the frontal region of scalp. Learned counsel further submits that the petitioner has clean antecedent and he is in custody since 20.08.2025 and charge-sheet has been submitted.

5. Learned APP for the State vehemently opposed the prayer for bail of the petitioner.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner and submission of chargesheet, the petitioner above-named, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rs. Ten Thousand Only) with two sureties of the like amount each to the satisfaction of court of learned Judicial Magistrate, 1st, East Champaran, Motihari, /concerned court, in connection with Banjariya P.S. Case No. 92 of 2025, subject to the condition laid down under Section 480(3) of the B.N.S.. and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(iii) In case of non-appearance of the petitioner on single date or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned.
