2. The petitioners apprehend their arrest in connection with Bhaptiyahi P.S. Case No. 165 of 2025, dated 20.07.2025, registered for the offences punishable under Sections 191(2), 191(3), 190, 303(2), 351(2), 352, 115(2) and 109 of the B.N.S., 2023.
3. As per allegation in the FIR, the accused persons including the present petitioners came variously armed to the
Patna High Court CR. MISC. No.77180 of 2025(2) dt.27-11-2025 2/3 field of the informant and indulged in assault causing injuries.
4. Learned counsel for the petitioners submits that it would be apparent from the FIR that there are general and omnibus allegations against the present petitioners and the allegation is specific against one Pradip Gupta of inflicting a kudal blow over the head of the informant rendering him unconscious. Further, the other allegations are merely ornamental in nature. It has also been submitted that there is case and counter case and the cases have originated out of civil dispute for which a Title Suit is also pending between the parties. The injury report of the informant's husband, which is annexed as Annexure-P/3 to the present bail application, indicates that the injury is also simple in nature and as a matter of fact, injuries were suffered on the side of the petitioners also.
5. Learned Additional Public Prosecutor for the State on the other hand vehemently opposes the prayer for grant of anticipatory bail to the petitioners.
6. Taking into consideration the facts and circumstances of the case and further considering the fact that there are general and omnibus allegations against the petitioners, existence of case and counter case coupled with the fact that the injury is also simple in nature, let the petitioners,
Patna High Court CR. MISC. No.77180 of 2025(2) dt.27-11-2025 3/3 above-named, in the event of their arrest or surrender before the Court concerned within a period of four weeks, be released on anticipatory bail, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Bhaptiyahi P.S. Case No. 165 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the BNSS. (Soni Shrivastava, J) Shahnawaz/- U T
