JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-09-2018 Heard learned counsel appearing on behalf the petitioner and counsel appearing on behalf of the State. The petitioner is in custody since 04.01.2018 in connection with Sonepur P.S. Case No. 457 of 2017 for the offence under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner was not named in the F.I.R. The name of the petitioner figures in this case on the confessional statement of Co-accused Budhan Kumar. He submits that petitioner remained in custody since 04.01.2018 but unfortunately even after expiry of eight months petitioner was not put on T.I.P. He submits that coaccused Haresh Kumar Paswan @ Indal Paswan @ Haresh Paswan has already granted bail by Co-ordinate Bench of this Court vide order dated 09.07.2018 in Criminal Miscellaneous

Considering the aforesaid facts that petitioner has remained in custody for nearly eight months and on similar circumstanced other co-accused Haresh Kumar Paswan @ Indal Paswan @ Haresh Paswan has already granted bail by Coordinate Bench of this Court vide order dated 09.07.2018 in Criminal Miscellaneous No. 26591 of 2018, let the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Judicial Magistrate 1st, Saran at Chapra in connection with Sonepur P.S. Case No. 457 of 2017.
