The petitioner seeks bail in connection with Bela P.S. Case No. 207 of 2019 dated 09.09.2019 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The petitioner is in custody since 10.09.2019 and has clean antecedent.

It appears from the FIR that 27 litres of Nepali liquor is said to have been recovered from a pick-up van on which the petitioner along with others was found to be sitting.

Learned counsel for the petitioner has submitted that he was only a gratuitous passenger and

Patna High Court CR. MISC. No.70010 of 2019(2) dt.11-12-2019 2/2 did not know about the presence of the liquor bottles in the pick-up van.

Considering the period of custody of the petitioner and the clean antecedent, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge II Cum Special Judge, Excise Act, Sitamarhi in connection with Bela P.S. Case No. 207 of 2019.
