This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 366A of the Indian Penal Code, registered in connection with Koilwar, Gidha O.P. P.S.Case No.26 of 2022.
At the very outset, the learned counsel for the petitioner has submitted that, though there is allegation against the petitioner that he kidnapped the minor daughter of the informant, but she in her statement recorded under Section 164 of the Cr.P.C. did not support the prosecution case. She has stated that she, as per her own sweet will, went with the petitioner. She has also stated that she has solemnized the
Patna High Court CR. MISC. No.5158 of 2023(2) dt.02-05-2023 2/2 marriage with the petitioner. She has further stated that she came in court along with her father-in-law for recording her statement under Section 164 of the Cr.P.C.
Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur at Ara in connection with Koilwar, Gidha O.P. P.S.Case No. 26 of 2022, subject to the following conditions:-
1. The petitioner shall cooperate in the disposal of trial and make available available as and when required by the court.
2. If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
