Petitioner, who is in custody, seeks bail in connection with Supaul Nadi P.S. Case No. 02 of 2018 registered for the offences punishable under Sections 354, 354B, 376D, 323, 379, 120(B), 504, 506 and 34 of the Indian Penal Code.

Informant who is the victim girl has alleged that petitioner threatened her to withdraw the case lodged against him and on refusal he committed rape upon her and thereafter threatened her to not disclose the same.

It has been submitted on behalf of the petitioner that he has been falsely implicated in this case due to dirty village politics. Neither the girl has been medically examined

Patna High Court Cr.Misc. No.59066 of 2018(2) dt.09-10-2018 2/2 nor her statement was taken under Section 164 of Cr.P.C. He is in custody since 04.01.2018. Police has submitted Final Form in this case as not true.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Supaul in connection with Supaul Nadi P.S. Case No. 02 of 2018.
