JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-03-2023 Petitioner renews his prayer for regular bail in connection with S. Tr. No. 11 / 2020 arising out of Sheohar P.S. Case No. 243 of 2019 registered for the offence under Section 395 of the I.P.C. inasmuch as bail application of the petitioner was earlier rejected vide order dated 11/05/2022 passed in Cr. Misc. No. 50975 of 2021 without any observation. Learned counsel for the petitioner submits that there is no technical evidence against the petitioner. While rejecting the bail application of the petitioner this Court had taken note of the evidence discussed by the learned Sessions Judge i.e. technical evidence as well as CDR and the fact that the petitioner is an active member of the gang indulged in dacoity and used to dispose the looted amount
Patna High Court CR. MISC. No.7793 of 2023(3) dt.22-03-2023 2/2 through Hawala and has got 14-15 criminal antecedents. The SLP preferred by the petitioner against the order dt. 11.05.2022 passed by this Court has been dismissed as withdrawn in SLP (Crl.) No. 7229 / 2022 dt. 05.09.2022.
In that view of the matter, I am not inclined to grant regular bail to the petitioner at this stage. Accordingly, the prayer for bail is rejected. However, the petitioner may renew his prayer for bail after 2 years from today if trial is not concluded. (Anil Kumar Sinha, J) praful/- U T
