Mr.Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-11-2025 Earlier, vide order dated 04.11.2025, the pre-arrest bail application of petitioner no. 1 (Zainuddin Ansari) already stood dismissed as withdrawn.

2. Petitioner no. 2 & 3 apprehend their arrest in a case registered for the offence under Sections 115(2), 126(2), 352, 351(2), 351(3), 109(1) and 3(5) of the B.N.S., 2023.

3. As per F.I.R., petitioners and co-accused Zainuddin Ansari are alleged to have encroached the passage of mosque and upon protest by informant, they abused and assaulted him.

4. Learned counsel for the petitioners submits that allegation is general & omnibus. He further submits that during pendency of this case, dispute has been resolved and a joint compromise petition has been filed on behalf of the parties

Patna High Court CR. MISC. No.74775 of 2025(3) dt.27-11-2025 2/2 (Annexure - 2). Petitioners claim clean antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, let the above named petitioner no. 2 & 3, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Mohania, District - Kaimur in connection with Mohania P.S. Case No. 450 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S.
