2. The petitioner seeks regular bail in connection with Bodhgaya P.S. Case No. 442 of 2023 dated 25.05.2023, registered for the offences punishable under Sections 341, 354(A)(1)(i), 354(B), 504, 506 and 34 of the Indian Penal Code read with Sections 8 and 12 of the POCSO Act and Sections 3(i) (r)(s), 3(2)(va) of the SC/ST Act.
3. As per the prosecution case, the F.I.R. has been lodged against two named accused persons including the petitioner against whom there is an allegation of outrage the modesty of the informant and threatening her family to kill.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that the name of the petitioner has
Patna High Court CR. MISC. No.82615 of 2023(3) dt.08-02-2024 2/2 figured in this case due to the previous enmity between the family of the petitioner and informant. He further submits that the petitioner is a young boy of 19 years and also a student having no criminal antecedent and is in custody since 22.08.2023. Charge-sheet has already been submitted in this case and it is further submits that no case under SC/ST Act is made out against the petitioner.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.
6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge POCSO Court-cum-Additional District & Sessions JudgeVIth, Gaya in connection with Bodhgaya P.S. Case No. 442 of 2023.
