The petitioner seeks bail in a case registered under Sections 467, 468, 469, 471 & 414 of the Indian Penal Code. Allegedly, a stolen motorcycle is recovered from the petitioner.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 27-07-2019. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. The petitioner had no knowledge that the motorcycle in question is a stolen property. The

Patna High Court CR. MISC. No.71739 of 2019(2) dt.19-11-2019 2/2 petitioner has been made accused in the present case due to mistake of fact. There is no compliance of Section 100 of Cr.P.C.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chapra in connection with Marhowrah P.S. Case No. 517 of 2019.
