2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 143, 147, 148, 149, 307, 323, 341, 504, 506 of the Indian Penal Code and Section 27 of Arms Act.

3. As per prosecution case, the alleged occurrence took place between the two groups on a conflict over not giving pass to the barat party by the driver of the tractor. Due to this, firing was made by both sides.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to village politics. There

Patna High Court CR. MISC. No.78524 of 2023(2) dt.07-12-2023 2/2 is general and omnibus allegation against the petitioner. He is languishing in judicial custody since 16.2.2023. Moreover, similarly situated co-accused persons have already been granted bail by a co-ordinate Bench of this Court vide order dt 17.8.2023 passed in Cr. Misc. No. 49202 of 2023 and in support of this Annexure-P/2 has been annexed with this petition.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with Nadi P.S. Case No. 16 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII, Supaul.
