JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 This is an application for grant of anticipatory bail in connection with Kuchaikot P. S. Case No. 219 of 2019, disclosing offences under Sections 406, 409, 420, 120B of IPC and Section 7 of the E.C. Act.

As per F.I.R. during inspection of the P.D.S. Shop some irregularities were found in the P.D.S. Shop run by the PACS and the statement of the beneficiaries have also annexed with the F.I.R.

Submission of the learned counsel for the petitioner is that he is not the dealer, rather he has paid Manager of the P.D.S. Shop of the PACS and there is no allegation against the petitioner as per the statement of the beneficiaries. Moreover, the Chairman of the PACS has also been granted privilege of anticipatory bail, vide order dated 24.09.2019 passed in

Patna High Court CR. MISC. No.69420 of 2019(2) dt.05-11-2019 2/2 Criminal Misc. No. 58967 of 2019.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, he will be released on bail to the satisfaction of learned court below on the condition that he has to appear before the police as and when required, otherwise, prosecution is at liberty to move for cancellation of his bail bonds.
