JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Special Case No. 5753 of 2018 arising out of Khusrupur P.S. Case No. 143 of 2018 registered for the offences punishable under Section 30(a) of Bihar Excise Amendment Act, 2016. The first information report goes to show that in front of door of petitioner in huge quantity country made liquor was recovered when the police party raided the house of the petitioner. The wife of the petitioner was arrested whereas petitioner managed to escape from there.

Regard being had to the aforesaid facts and circumstances as well as submissions of the parties, I am not

Patna High Court Cr.Misc. No.57258 of 2018 (2) dt.20-09-2018 2/2 inclined to extend the privilege of anticipatory bail to petitioner and accordingly, his prayer for anticipatory bail stands rejected. However, if petitioner surrenders before the court below within six weeks from today and seeks regular bail, the learned trial court shall consider the regular bail application of the petitioner on its own merit without being prejudiced by this rejection order.
