JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 This is an application for grant of anticipatory bail in connection with Bettiah Muffasil P. S. Case No. 306 of 2019, disclosing offences under Sections 452, 341, 342, 323, 354(B), 506, 504, 34, of the Indian Penal Code.
As per F.I.R. petitioners and other accused persons entered inside the house of the informant, assaulted the nephew of the informant and abused the informant and also assaulted the daughter of the informant. Further allegation is against other
Patna High Court CR. MISC. No.68973 of 2019(2) dt.04-11-2019 2/3 accused persons of tearing the Saree and Blouse of the daughter of the informant.
Submission of the learned counsel for the petitioners is that earlier there was a case filed by the petitioner no.2 against the informant and others and due to that, the present case has been lodged by the informant against the petitioners. Further submission is that no specific allegation has been attributed against any of the petitioners.
Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Bettiah, District West Champaran, in connection with Bettiah Muffasil P. S. Case No. 306 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
