The petitioner seeks bail in Madhepur P.S. Case No. 35/2018, instituted for the offences under Sections 395 and 397 of the Indian Penal Code read with Section 27 of the Arms Act. Learned counsel for the petitioner has submitted that the petitioner is not named in the written report. Nothing has been recovered from possession of this petitioner. Not T.I.P. has been held by the police.

In the confessional statement, co-accused Chandan Mallik has taken the name of this petitioner stating therein that he had given Rs. 50,000/- to this petitioner, which is alleged to have been recovered from possession of this petitioner.

Patna High Court Cr.Misc. No.55338 of 2018 (2) dt.20-09-2018 2/2 petitioner is in custody since 15.04.2018 Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IInd, Jhanjharpur, Madhubani in connection with Madhepur P.S.
