JUSTICE SANJAY PRIYA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Neemchandpura P.S. Case No. 70 of 2017 instituted for the offence under Section 30(A) of Bihar Prohibition of Excise Act, 2016.
It is alleged in the written report that informant after receiving secret information that foreign liquor is being loaded on a container, the police chased the container but driver and owner of the vehicle managed to run away. It is further alleged that two persons were apprehended. They disclosed their name as Dilkhush Kumar @ Dilkhush Tanti (petitioner) and Rajiv Kumar. The petitioner is in custody since 4.8.2018.
From the written report it appears that there is no recovery from conscious possession of the petitioner.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Begusarai, in connection with Neemchandpura P.S. Case No. 70 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
