JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Paliganj P.S. Case No. 163 of 2018 registered for the offences punishable under Section 420 of the Indian Penal Code and Section 66(C) of I.T. Act.

As per FIR when informant did not succeed in withdrawing amount from the ATM the petitioner assisted him and transferred total amount of Rs.73,500/- to another account by changing his ATM.

Submission of learned counsel for the petitioner is that he is an Agent of Customer Care and in good faith he assisted the informant but he has falsely been implicated in this case.

Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that there is direct allegation

Patna High Court CR. MISC. No.69412 of 2019(2) dt.05-11-2019 2/2 against the petitioner of changing the ATM of the informant and withdrawn the amount.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He has to surrender and pray for regular bail. This application is, accordingly, dismissed.
