Petitioner apprehends arrest in a case registered for the offence punishable under Sections 406 and 420 of the Indian Penal Code.

As per the prosecution case, the petitioner along with other accused executed a deed of agreement to sell a piece of land and on this pretext they took Rs. 9 lacs from the informant but they never executed sale deed in favour of the informant. Learned counsel for the petitioner submits that as per FIR and agreement, the petitioner has taken only Rs. 3,00,000/- and except this there is no cheat of paper to support the allegation. He further submitted that the agreement took place in the year 2012 and after about 10 years the FIR was lodged,

Patna High Court CR. MISC. No.6471 of 2023(2) dt.11-05-2023 2/2 without explanation of delay. He further submits that the informant has even tried to implicate the son of the petitioner by sending Rs. 10,000/- to his account. The petitioner claims clean antecedent.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 2nd Class, Patna in connection with Buddha Colony P.S. Case No. 95 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Alok Verma/- U T
