Petitioner prays for bail in connection with Sirdala P.S.Case No. 168 of 2017 registered for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code. Allegation against the petitioner, who happens to be husband the deceased, is of setting his wife on fire and causing her death.

Submission of learned counsel for the petitioner is that FIR itself shows that petitioner has given information to the informant and he along with informant has taken her to hospital where she died and FIR has been lodged after seven days of the occurrence due to ulterior motive and in this case charge sheet has been submitted and petitioner is in custody since 4.7.2018.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Nawada, in connection with Sirdala P.S.Case No. 168 of 2017, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
