JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 This application, for grant of anticipatory bail, arises out of Patepur P.S. Case No. 151 of 2019, disclosing offences under Sections 363, 366(A) and 34 of the Indian Penal Code.

Prosecution case is that son of the petitioners kidnapped the minor sister of informant.

Submission of learned counsel for the petitioners is that they are father and mother of the co-accused against whom there is allegation of kidnapping the sister of informant and as a matter of fact the girl has married with their son and a petition

Patna High Court CR. MISC. No.70280 of 2019(2) dt.06-11-2019 2/2 has also been filed by the girl in the court of learned Chief Judicial Magistrate.

Heard learned A.P.P. also.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Patepur P.S. Case No. 151 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is further subject to the condition that they will appear before the investigating officer and assist in recovery of the girl.
