JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 11.8.2019 in connection with Kadwa P.S. Case No. 184/2019 registered for the offences punishable under Section 394 of the Indian Penal Code.
No doubt, the petitioner is named in the first information report but the informant states that co-villagers claimed before him that they had seen the petitioner fleeing near the place of occurrence. It appears that, subsequently, the petitioner was arrested and made his confessional statement leading to recovery of 30,000/- from his house.
Submission on behalf of the petitioner is that the
Patna High Court CR. MISC. No.69478 of 2019(2) dt.18-12-2019 2/2 petitioner has not been put on test identification parade and so far as recovery of Rs. 30,000/- is concerned, the same belongs to petitioner and, moreover, petitioner does not have any criminal antecedents.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Kadwa P.S.
