Petitioners pray for bail in connection with Keoti P.S.Case No. 171 of 2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. Allegation against the petitioners is of assault by fists and slaps to the deceased, causing his death.
Submission of learned counsel for the petitioners is that the deceased was suffering from old ailments and due to that he died and petitioner have falsely been implicated in this case and they are in custody since 24.6.2018. Further submission is that similarly situated co-accused persons have been granted bail by a co-ordinate Bench of this Court vide order dated 17.5.2018 passed in Cr.Misc.No. 23353 of 2018 and charge sheet has been

Having heard both sides and in the facts and circumstances, let the petitioners, named above, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VII, Darbhanga, in connection with Keoti P.S.Case No. 171 of 2017, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
