====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-03-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30(a) and 41(1) of Bihar Prohibition and Excise (Amendment) Act, 2018. As per prosecution case, 9 liters of foreign liquor has been recovered from tempo of which petitioner is a registered owner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Nothing has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent. Learned A.P.P. for the State opposes the prayer for bail submitting that the petitioner is owner of the vehicle in

Patna High Court CR. MISC. No.75298 of 2022(2) dt.18-03-2023 2/2 question.

Considering the aforesaid facts, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
