The petitioners seek bail in a case registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) (d) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 3 litres of country-made liquor was recovered from the house of coaccused Kishore Chaudhary and 30 litres of Mahua liquor was recovered from a Cabin. Petitioners were allegedly apprehended while they were tried to escape from scene. It is contended that nothing has been recovered from the conscious possession of the petitioners and they have been falsely implicated in the
Patna High Court Cr.Misc. No.59680 of 2018(3) dt.08-10-2018 2/2 present case on suspicion. Petitioners claim that they are having clean antecedents and are in custody since 11.08.2018. Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on their furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Gaya, in connection with Atri P.S. Case No. 277 of 2018.
If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
