2. Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109(1), 121(1) and 132 of B.N.S., 2023.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the allegation against the accused persons including the petitioners is of causing interruption in discharge of government duty and
Patna High Court CR. MISC. No.75895 of 2025(3) dt.23-12-2025 2/3 assaulting the police personnel beside the allegation of misbehaving, abuse and threatening.
4. Learned counsel for the petitioners submits that a supplementary affidavit is being filed in compliance of the order dated 18.12.2025, which is taken on record. It is next submitted that at para-2 of the supplementary affidavit, it has been specifically stated that petitioners have never been arrested in this case, as such, the order impugned inadvertently at para-2 of the first page records that petitioners were arrested. It is also submitted that similarly situated co-accused, like, the petitioners had moved before this Court seeking anticipatory bail by filing Criminal Miscellaneous No.84273 of 2025 and the same was allowed by an order dated 15.12.2025 passed by a learned Coordinate Bench and thus, the petitioners based on parity seeks anticipatory bail. It is further submitted that from perusal of the allegations, as alleged in the FIR, it would manifest that allegation of abuse, assault and threatening is general and omnibus in nature.
5. Learned APP for the State opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioners, let petitioners, above-named, in the
Patna High Court CR. MISC. No.75895 of 2025(3) dt.23-12-2025 3/3 event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Gopalpur P.S. Case No.310 of 2024, subject to the conditions as laid down under Section 482(2) of the B.N.S.S. (Satyavrat Verma, J) Sanjay/- U T
