The petitioner seeks bail in Buxar (Town) P.S. Case No.165 of 2018 registered under Sections 386, 307 and 34 of the Indian Penal Code as well as under Section 27 of the Arms Act.

The informant alleged that while he was returning after closing his shop, two unknown persons opened firing but the informant entered into his house. After sometime the informant and his family members went to the place of occurrence and recovered an empty cartridge.

The learned counsel for the petitioner submits that the petitioner is not named in the FIR. Name of the petitioner figured in the case in the confessional statement of a coaccused. Petitioner was not put on TIP. There is no material to

Taking into consideration the facts aforesaid and the fact that the petitioner has already remained in jail for about 41⁄2 months and he has got no criminal antecedent, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar in connection with Buxar (Town) P.S.
