The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 30, 30(a), 30(b) and 33 of the Bihar Prohibition and Excise Act, 2018. Total 200 litres of Chulai liquor has been recovered from Manikchak Chour.
It is submitted that name of petitioner transpired in this case on the basis of confessional statement of co-accused Manoj Ray who was apprehended on the spot. Nothing has been recovered from conscious possession of this petitioner and he was also not apprehended on the spot. Petitioner claims clean antecedent.
Considering the facts aforesaid, the petitioner above-
Patna High Court CR. MISC. No.344 of 2023(2) dt.18-03-2023 2/2 named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum- Ist Exclusive Special Judge Excise, Chapra, Saran in connection with Dariyapur P.S. Case No. 141 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
