====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in connection with G.O. Case No.743 of 2018, arising out of Singhwara P.S. Case No.171 of 2018, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that on receiving secret information about unloading of the Indian Made Foreign Liquor in villageBharwara, the informant along with other police officials reached at village-Bharwara and raided the Pulse Mill of Shivji Sah and found a truck standing in the campus of the Pulse Mill. At that time, on seeing them, several persons started to flee

Patna High Court Cr.Misc. No.62438 of 2018(2) dt.06-10-2018 2/2 away from there but, on chase, four persons including the petitioners were apprehended by the police and all confessed their involvement in the business of liquor.

Learned counsel appearing on behalf of the petitioners submits that, in fact, the petitioners had gone at the Pulse Mill of Shivji Sah to purchase the pulse but, in the meantime, both the petitioners were apprehended by the police. The petitioners having no criminal antecedents are in custody since 24.08.2018. Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-IV-cumSpecial Judge, Darbhanga, in connection with G.O. Case No.743 of 2018, arising out of Singhwara P.S. Case No.171 of 2018.
