2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 70(2) of the Bharatiya Nyaya Sanhita, under Sections 4 & 6 of the POCSO Act and under Sections 3(2)(iv) & 3(2)(v) of the SC/ST Act.
3. The case of the prosecution is that this petitioner has given his mobile number to the informant and has asked her to call him whenever she comes to Subhas Park.
4. Learned counsel for the petitioner has submitted that the main thrust of allegation are against other accused persons and this petitioner has not done any illegal act with the
Patna High Court CR. MISC. No.76477 of 2025(2) dt.19-11-2025 2/2 girl. From perusal of the order of the learned trial court it is also clear that medical board has opined that the age of the victim is 18-19 years. The petitioner is in custody since 13.06.2025 having clean antecedent.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Laheri P.S. Case No. 270 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IVcum-Special Judge (POCSO), Biharsharif, Nalanda.
